해당 물질에 대한 확인이 왜 필요한가요?

네, 이 물질들 모두 발암성, 생식독성, 그리고 자연계에 큰 위험을 준다는 것을 실험을 통해서 확인 하였기 때문입니다.

해당 물질들이 혼합물에 들어 갈수 있는 최대한의 한계치가 설정되어 있습니다.

각 규정에 따라서 추가적으로 엄청난 결과들이 나타날수 있습니다.

수출이 안되니 해외 고객을 잃어 버릴수도 있구요, 거짓으로 소명 하면 추가적으로 법적 대응도 예상이 됩니다.

 

EU 에서는 자가 선언을 아주 중요하게 생각합니다. (아래 에 해당 양식이 있습니다. 필요하신 분은 사용하세요)

자가선언이 기준으로, 해당 규제에 대한 미이행에 대한 증빙이 되기때문입니다. 추후 법적인 조치가 일어 나겠군요.

따라서 어떤 바이어들은 3자를 통해서 해당 실험을 요청 하기도 합니다.

SVHC이야기를 하다가 왜 REACH로 이야기가 가냐구요? 네, 이부분이 사실 SVHC의 모체 이기 떄문입니다.

 

REACH 란?

유럽화학청, ECHA -  European Chemicals Agency에서는 여러가지 관련 법규를 관리 하고 있습니다.

 

REACH - 규정 (유럽 연합의) 화학물질 등록, 평가 허가 및 제한 영어로 바꿔보면

                Registration, Evaluation, Authorization, and Restriction of Chemical 각 단어의 첫 글자를

                딴 규정입니다. Regulation (EC) No 1907/2006

 

여기에서 Restriction of Chemical 항목이 보이지요?

이 부분이 REACH의 규제 프레임워크의 핵심 입니다. 

상식 선에서도, 위험한 물질에 대한 규제나 요구사항이 더 많기 때문이지요.

 

좋은 법입니다. 

해당 규제 프레임워크의 목표 (Goal, Deliverable)

 - 인간의 건강과 환경 보호

 - 화학 물질 정보의 투명성 확보

 - 화학 산업의 경쟁력 유지

 - 혁시 촉진 및 지속 가능한 개발 

등을 이야기 하고 있습니다.

 

다만 REACH에서는, 혼합물질 자체가 아니라 구성 물질이 이미 등록되어 있다면 혼합물질 등록은 면제 될 수 있습니다.

추가적은 내용은 관련되 규정집을 보시면 됩니다. (exemption) 

 

혼합물질 등록은 면제될 수 있기 때문에, 이미 등록된 화학물질에 대한 정보가 SDS에 기재가 되어 있으면 REACH 등록은

안하셔도 됩니다. 다만, SDS에 작성된 substance 의 CAS No. 가 ECHA에서 검색이 되셔야 합니다.

등록의 면제 사유가 혼합물질의 개개의 화학물질이 등록이 되어 있어야 하기 때문입니다. 

 

위 문서가 있다면, 한국에서 유럽으로 수출은 아무런 문제가 없습니다.

다만, 가끔 유럽 수입 통관시  REACH Compliance Certificate를 요구 할때가 있습니다.

 

REACH COMPLIANCE CERTIFICATE/ REACH COMPLIANCE DECLARATION

 

해당 문서는, 

   RoHS ( Restriction of Hazardous Substances, Directive 2011/65/EU) 와 앞서 언급된 SVHC에 대한 소명을

   자가적합성 선언 (제조사 스스로 소명하는 형태)를 하셔야 합니다. 아래 10가지 항목 더하기, 

   

• 납 (Lead, Pb): 0.1% (1000 ppm) 이하
• 수은 (Mercury, Hg): 0.1% (1000 ppm) 이하
• 카드뮴 (Cadmium, Cd): 0.01% (100 ppm) 이하
• 6가 크롬 (Hexavalent Chromium, Cr6+): 0.1% (1000 ppm) 이하
• 폴리브롬화 비페닐 (Polybrominated Biphenyls, PBB): 0.1% (1000 ppm) 이하
• 폴리브롬화 디페닐 에테르 (Polybrominated Diphenyl Ethers, PBDE): 0.1% (1000 ppm) 이하
• 비스(2-에틸헥실) 프탈레이트 (DEHP): 0.1% (1000 ppm) 이하
• 부틸 벤질 프탈레이트 (BBP): 0.1% (1000 ppm) 이하
• 디부틸 프탈레이트 (DBP): 0.1% (1000 ppm) 이하
• 디이소부틸 프탈레이트 (DIBP): 0.1% (1000 ppm) 이하

이 웹페이지에서, 상단에 위치한 Showing 1-50 of 240 result 라고 작성이 되어 있습니다. 

 

 

네 총  240까지 항목이 REACH Compliance 에 내용이 기재 되어 있어야 합니다.

추가적으로, Date of inclusion 추가된 날짜를 확인 합니다. (23-Jan-2024)

 

제조소에서 사용하는 화학물질이 최종 배합되어 출하 되는 제품에 해당 물질이 있는지는 꼭 확인 하셔야 합니다.

SVHC경우에는 대부분 1000ppm 단위로 설정이 되어 있지만,

특수한 경우도 있기에 ECHA-SVHC 싸이트에서 확인이 요구됩니다.

 

이제 필요한 정보들은 모두 취득을 하셨다고 봅니다.

가끔, 정말 가끔 고객사 분들중에서는 3자 실험을 요청하는 경우도 있습니다.

 

이런 경우에는 비용도 들고, 시간도 들고 합니다.

이런경우에는 SGS 또는 TUV를 통해서 실험을 진행 하시면 됩니다.

 

RoHS 항목, 프탈레이트 항목, SVHC를 유선상 혹은 메일로 요청 하시면 됩니다.

 

해당 증빙자료를 포함하여, 이제 Compliance Certificate를 작성해 보도록 하겠습니다.

If the substances’ concentration in the referred articles (products) are above 0,1 % weight by weight (w/w) they have to provide the recipient of the article with sufficient information, to allow safe use of the article including, as a minimum, the name of that substance.  Substances of Very High Concern (SVHC) – Annex XIV As of January 23, 2024 - Candidate List of substances of very high concern for Authorisation - ECHA (europa.eu) -  ECHA  (The  European Chemicals Agency) has placed 5 new substances in the  Candidate  List of  Substances of  Very  High  Concern (SVHC) for authorization. Any SVHC must not be used,  manufactured, or imported without the prior authorization of the ECHA. The Candidate List will be updated and published periodically as more substances are identified as SVHC.  As of today, [회사명] did not identify one component or compound, that does not comply with this Regulation. This company closely works with its supply base to identify non-compliances and to eliminate these in case some would be found.
